1. Acceptance of Terms

These Terms and Conditions form a legally binding agreement between you and Pemsoft, the developer and operator of PEM Sports. By accessing or using PEM Sports, you confirm that you have read, understood, and agree to these terms. Your continued use of the app constitutes ongoing acceptance.

2. Eligibility

To use PEM Sports you must:

• Be at least 16 years of age
• Have the legal capacity to enter into a binding agreement in your jurisdiction
• Not be prohibited from using the app under applicable law

If you are between 16 and 18, you represent that your parent or legal guardian has reviewed and agreed to these terms on your behalf.

3. Account Registration

Certain features of PEM Sports require you to create an account. When registering you agree to:

• Provide accurate, current, and complete information
• Keep your login credentials confidential and not share them with others
• Notify us promptly at support@pemsoft.org if you suspect unauthorised access to your account
• Accept responsibility for all activity that occurs under your account

4. Permitted Use

PEM Sports is licensed to you for personal, non-commercial use to support your fitness and training goals. You may use the app only in accordance with these terms and applicable law.

5. Prohibited Conduct

You may not use PEM Sports to:

• Reverse engineer, decompile, or attempt to extract the source code of the app
• Scrape, copy, or redistribute any content without prior written permission from Pemsoft
• Upload or transmit any malicious code, spam, or unlawful content
• Impersonate another person or misrepresent your affiliation with any entity
• Use the app in any way that could damage, disable, or impair our systems or services
• Access or attempt to access another user's account or data

6. Intellectual Property

All content, design, trademarks, code, and features within PEM Sports are the exclusive property of Pemsoft or its licensors and are protected by applicable intellectual property law. Nothing in these terms grants you any right to use Pemsoft branding or intellectual property beyond what is strictly necessary to use the app for its intended purpose.

7. User Content and Data

You retain ownership of all fitness data, notes, and other content you create within PEM Sports. By using the app, you grant Pemsoft a limited, non-exclusive, royalty-free licence to store, process, and display your content solely to provide the service to you.

You are solely responsible for the accuracy and legality of the content you submit. Pemsoft does not claim ownership of your personal data and will handle it in accordance with our Privacy Policy.

8. Premium Features

PEM Sports offers optional paid features under a Premium subscription. Premium subscriptions are billed on a recurring basis at the frequency selected at purchase. You may cancel at any time through your device's app store account settings. Cancellation takes effect at the end of the current billing period. Pemsoft does not offer refunds for partially used subscription periods unless required by applicable law.

9. Disclaimers

PEM Sports is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. Pemsoft does not guarantee that the app will be free of errors or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Pemsoft and its employees, directors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, PEM Sports. This includes loss of data, personal injury, or property damage.

Where liability cannot be excluded by law, Pemsoft's total liability to you shall not exceed the amount you paid to Pemsoft in the twelve months preceding the claim, or fifty euros (EUR 50), whichever is greater.

11. Termination

Pemsoft may suspend or terminate your access to PEM Sports at any time, with or without notice, if you violate these terms or if we reasonably believe your use poses a risk to us, other users, or third parties. Upon termination, your right to use the app ceases immediately. Provisions of these terms that by their nature should survive termination will continue to apply.

12. Changes to These Terms

Pemsoft may update these terms from time to time. Material changes will be communicated via in-app notification or email at least 14 days before they take effect. Your continued use of PEM Sports after the effective date of any change constitutes acceptance of the revised terms.

13. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the country in which Pemsoft is registered.
